Welcome to FindMiCash. These Terms of Service ("Terms") govern your access to and use of the FindMiCash application, website, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
"Service" refers to the FindMiCash expense, budget and income tracking application, including all features, tools, and content provided through the platform.
"User," "you," or "your" refers to any individual or entity that accesses or uses the Service.
"Account" refers to the registered account you create to access the Service.
"Content" refers to any data, text, information, or materials you submit, upload, or transmit through the Service.
You agree not to use the Service to:
Ownership: You retain all rights to the data and content you submit to the Service. We do not claim ownership of your financial data, expense records, or any other content you provide.
License: By using the Service, you grant us a limited, non-exclusive license to process, store, and display your content solely for the purpose of providing and improving the Service.
Data Portability: You may export your data at any time using the export features available within the Service.
Accuracy: You are solely responsible for the accuracy and completeness of the data you enter into the Service. FindMiCash does not verify or validate your financial data.
Optional: Connecting a bank or card account is optional. You can use the Service without it.
Your authorization: When you connect an account, you authorize FindMiCash and our provider Plaid Inc. ("Plaid") to access and retrieve information from that account on your behalf, namely account names, the last four digits of account numbers, the institution's name, and transactions (up to 24 months of history and new transactions as they arrive), and to store it in the Service. You also agree that Plaid will handle your information under the Plaid End User Privacy Policy.
Read-only: The connection only reads information. FindMiCash does not and cannot move money, make payments, or change anything at your financial institution.
Your authority: You may connect only accounts that you own or are authorized to access. By connecting an account, you confirm you have that authority. Imported transactions are shared with your household according to the roles you set.
Accuracy: Imported information comes from your financial institution through Plaid. We do not control it and do not guarantee that it is complete, accurate or up to date. Pending transactions may change or disappear. Check your institution's statements for official balances and activity.
Third-party availability: The feature depends on Plaid and on your financial institution. They may be unavailable, may stop supporting an institution, or may ask you to sign in again, and we are not responsible for their outages or changes.
Disconnecting: You can disconnect an account at any time in the app. We then end the connection with Plaid and delete our access key; transactions already imported stay in your records until you delete them. You can also revoke access through Plaid at my.plaid.com. Connections end automatically when a free trial ends without a plan, when a paid plan is cancelled, or when the account is deleted.
Not a bank or adviser: FindMiCash is not a bank, lender, payment service, or financial adviser. It does not hold your money, and nothing in the Service is financial, investment, tax or legal advice.
The Service, including its original content, features, functionality, design, and branding (excluding your Content), is and remains the exclusive property of FindMiCash and its licensors.
The FindMiCash name, logo, and all related trademarks, service marks, and trade names are the property of FindMiCash. You may not use these marks without our prior written consent.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, FindMiCash disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy of any financial calculations, reports, or insights generated by the Service.
FindMiCash is not a financial advisor, accountant, or tax professional. The Service is a tool for tracking and organizing expenses and should not be relied upon as financial, tax, or legal advice.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINDMICASH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Service.
In no event shall FindMiCash's total aggregate liability exceed the amount you have paid to FindMiCash in the twelve (12) months preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless FindMiCash and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the Service.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions.
Informal Resolution: Before filing any formal legal action, you agree to first attempt to resolve the dispute informally by contacting us. We will attempt to resolve the dispute within 30 days.
Arbitration: Any dispute not resolved informally shall be resolved through binding arbitration, rather than in court, except that either party may seek injunctive relief in court for intellectual property matters.
Class Action Waiver: You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.
We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
